Exclusive Use of Facility Guidelines

1. The Counterparty renting the CHSC facilities has thoroughly reviewed all of the AUB and University Sports related information posted on the AUB website at www.aub.edu.lb/sao/sports/chsc/ .
2. The use of all AUB Student Affairs supervised facilities is to be scheduled through AUB University Sports division and only those facilities scheduled may be used while on campus. 
3. The individuals using the CHSC facilities or any other AUB Student Affairs supervised facilities shall be supervised by the Counterparty (One supervisor for every 20 individuals, unless otherwise agreed in writing by AUB) and shall leave the AUB campus after use of any such facilities. 
4. AUB functions planned or unanticipated will always take precedence over any exclusive facility use.
5. Should there be a need for outdoor lighting and/or custodial care or any other services, the Counterparty will be billed the rates generally applied by AUB.
6. AUB will not provide on-campus parking for the Counterparty or its Participants.
7. This Agreement is expressly subject to and conditional upon the Counterparty and its Participants complying with AUB applicable policies and procedures which are hereby incorporated into this Agreement as additional terms. 
8. The Counterparty assumes full liability for accidents that may occur while using the CHSC facilities and any other AUB Student Affairs supervised facilities and will be responsible for repairing damage done to such facilities or other AUB property.
9. The Counterparty, not AUB, is responsible for loss, theft of, or damage to any personal property of its Participants located within AUB property pursuant to this Agreement.
10. AUB hereby expressly disclaims and excludes all warranties concerning the CHSC facilities and any other AUB facilities and does not guarantee that such facilities or their equipment will be functional at all times.
11. The Counterparty shall maintain the following insurance policies with appropriate cover for at least the term of this Agreement:      

(a)     Workers compensation insurance covering its staff accessing AUB property.

(b)    Liability insurance covering personal injury, death, medical expenses, and property damage (including theft) in relation to occurrences suffered or caused by its Participants while on AUB property.  

12. The Counterparty shall, on demand, indemnify and hold harmless AUB, its trustees, officers, agents, and employees, from and against all losses, expenses, claims, demands and legal actions of every kind and character for death, personal injury, property damage or any other liability arising out of or in any way connected with the access to and use of the CHSC facilities or any other AUB property.   
13. This Agreement will be governed by Lebanese law and any dispute arising in relation to this Agreement will be exclusively settled by the Beirut courts.
